In 2003 I (competioner) have filed the paper work for my son(principal beneficiary) and his family (wife and 2 sons) to come to America from VietNam . Form I-130 . It's been approved by USCIS and all the papers are now at NVC . In Sept, 2009 we recieved a letter from NVC said that they have to wait for available visas .
The question is : My son just passed away on Nov 5th, 2011 . ( car accident in Vietnam) , what can we do next ? I already sent the Death Certificate to USCIS and NVC . Could my daughter-in-law and my grandkids could come to US without my son since the paper been approved by USCIS and they are waiting for the available visa ?
I'm not so sure what to do next . Could I hire a lawyer to help me with the paperwork so that my son's wite and 2 kids could come over or they could come over sooner ? I heard some people said so, but I'm not sure . Please help me !
Thank you so much !
