  • Time to file H1B

    Hi,

I am on opt extension right now and its just started from this January 2013 and it will be expired on 1 jun 2014. Now I want my company to file H1 for me. Will it be okay if they will file my H1 for fiscal year 2015 because I want to use my full OPT extension time.
As per USCIS, i can work if my opt extension has expired and H1b file in process.
Or Should I ask my company to file my H1 for fiscal year 2014 .

    Please answer my question...

Yes, that is possible. Your OPT expiry date should fall after Apr 1 for you to avail of cap-gap. But do make sure that you are eligible for OPT extension and that your employer is enrolled in EVerify.
This is my opinion and not legal advice.
