  • B1 visa get rejected for long stay(not overstay) in U.S before

VO: What's your purpose of this trip to America?
    ME: Business trip
    VO: Are you married?
    ME: No yet.
    VO: Not yet?
ME: I mean I have a girlfriend, but we are not married yet.
VO: When do you get married?
    ME: About this winter.
VO: Did she come with you this trip?
    ME: No.
    VO: Why not?
ME: Because we're not in the same company.
VO: You know why you are called here today for an interview?
    ME: NO.
VO: According to the records, you've stayed in U.S for almost 6 months for the first entry, and 5 month for the second entry during last year. So What were you doing then?
ME: I was doing some project analysis, and project management to coordinate the team work between xxx(my company name) and xxx(customer company name)
VO: In July 2013, you came to told us you will stay two weeks in America, but you had stayed for almost 6 months, why did you stay so long?
ME: Because our customer required us to do some onsite job for them, and here is the contract...
VO: I don't wanna see it. Why you stayed so long in US?
ME: blabla... (Things like our customer required us to do so)
VO: This is not gonna happen

I felt really bad for this failure. What did I do wrong? I returned home on time, as to why I stayed so long, why the customs dept. granted me 6 months stay? I'm afraid of that they will consider this as a cheating. So how bad will this be? Is there any chance for me to apply for the B1 visa again or do I have to apply for a different type visa?

The answer to rejection lies in the interview itself. The nature of B1 itself is for "short duration" and "business purpose". 6 Months/5 Months stay doesnt sound very convincing for B1. You should consider a L1/H1.

This is my opinion not legal advice.

So, there is still some chance for applying for a H/L type visa, right? Hope I'm not on their blacklist!

First of all you should not work in the USA on a B visa. Should't stay longer even they granted up to
6 months on B1. You may stay with an entry of B2 but not B1.

How the VO concluded the interview?
What were his final words exactly?
Did you receive any slip or form from him?

This is my opinion, not a legal advice.

She didn't say it is a fraud, but things looked like so.

What were his final words exactly?
The last word of the VO is "That will never gonna happen"

Did you receive any slip or form from him?
Yes, she gave me a white paper. It's a normal rejection notice saying things like "Can't grant you such a visa" etc.

You are not permanently barred it seems but they may give you tough time if you apply again for B1/B2.

As other senior member suggested, you can try for L1 or H1 visa.

                Good luck.

Thanks. Can't believe things come out like such a mess.
