Reason for rejection of B1 visa when my immigration petition is pending.

  • Reason for rejection of B1 visa when my immigration petition is pending.

    Dear I applied for B1 type businesse visa as I had to go us to attend business meetings in one of associate company of my Indian employer.

    My petition for immigration in F3 category is filled and it is pending.

    I don't know why but my B1 visa rejected and simple reason given to me was their standard paper stating clause 124(B).
    I carried all the documents to prove my bonding in India like my house dastavej , bank statements income tax returns my employment letter etc.
    But the officer didn't ask to show any document and simply my visa rejected.

    Can any body guide the probable reason .

    Already having a family based immigration petition is the primary cause of the rejection. B1 is for non immigrant intent, whereas by filing an F3 you have already shown an immigrant intent. In such cases officers rarely grant a visitor visa, simply because they fear that you will stay in US and not come back. Overstaying on your B1 visa would also not jeopardize your F3 petition because you would have entered legally (on B1 visa).
