  • B1 - Help

    Hi,

My employer filed a B1 visa for me last year and i was issued the same. But my marital status was represented wrongly as married, when i was unmarried.
I would like to get this information corrected.

Also now i am married and would like to travel on dependent visa. Will this create any problem?

Can some one please help me on this?

    What kind of dependent visa is it? H-4, L-2, J-2, F-2 ?

If you try to correct your mistake about the last B1 , they may think you lied to get the visa and may cancel it and also your H-4 may be in jeopardy.
They believe it was your responsibility to check the correctness of your B1
        application.

If they do not probe you about the date of your marriage , you could get the
H-4. But if they do, it could be a problem. They may buy your argument and they may not.

Another way out is , go to US on your B1 and change status to H-4 in US.
They do not have any interview changing status so you won't have any problems.

          Thanks for the reply.

Does the consulate refer to old docs (B1) while filing for H4 and identify the difference? Marriage certiface talks about the date is the concern i have.

Also is it not illegal to enter on B1 and change the status to H4 intentionally?

They do all sorts of cross checks these days, due to high fraud in India , terrorism etc. If they will take notice of your marriage date
can't be said. But it is risky.

There is no problem changing status in US.
Do not mention to the entry officer though. Your spouse can enter on an H-1 and you on a B-1 showing a business purpose.

The only difficulty with changing status in US, is if you have to travel outside US, you will have to get an H-4 stamp in your passport to reenter again.
I suggest you enter on a B-1 and then talk to a good attorney in US.
Applying for an H-4 at embassy is risky.
