  • B1 Business Visa Help,

    I have a major problem , recently my Business visa got denied under 214(b) act.

    Actually i had invitation letters from my clients which i got last year, i changed the dates in the invitation letters to make it look recent. Immigration officer was able to detect it and denied my visa. He also added notes about this in his computer.

    Can i now get client approval for changed dates and re-apply for Visa? please tell me what will be the outcome of this.
    All my clients are ready to provide approval for this tell me whether it will work and will they give me permission to re-enter US?

    why didn't you do this in the first place? altering documents is NOT ok.

    You can re-apply, but you need to give it some time and will have to provide a lot more evidence of strong ties to your country than "invitation letters" whether they are real or not.

      Thanks for quick reply. I was just too careless. I can get 50 letters since we have that much clients in US. Actually i run a company of 50 employees and our full business focus is US. It was easy for me to get B1 visa first time but now i made a total mess of it. This was just due to my carelessness

      My visa was rejected under section 214(b). Actually the Offficer asked me for the approval letter from client to change dates but i didnt have it with me when i was in interview.

      I have a good profile since i am a Business owner also i don't want to be called a fraud person because our whole business depends on US and its important i travel to US often.

      I do have very strong ties with home country and have evidence for supporting that. Only this careless letter mistake messed up things. I asked the immigration Officer whether i can re-apply he said yes but he has left a strong note on my Name probably something related to fraud.

      Tomorrow ill be getting the letters from my clients that the date change was done with their approval do you think its good to present those letters in the next interview which i want to happen soon.

        It was not the right thing for you to change the dates which you already realize. Apply again as your rejection was not under a permanent ban section of the law but 214b is just for immigrant intent. If you can prove ties to home country, you should be fine.

          I have solid reasons to show my tieups with home country. I am the Chairman of the company and definetely i cannot leave my company and stay long in US,

          I am reapplying now mainly to see what are the stuff i messed up so that ill be able to clear everything. Even if my visa is denied now i don't have a problem i want to hear what the Officer says.

            You could be the Chairman or the CEO of the company, but the VO has lost trust in you during the interview because of the date changes made on the letters.

            You should be glad they did not categorize your case under fraud/misrepresentation which would have resulted in a permanent ban.

              Hello txh1b,

              How do you know i am not catagorized as fraud or Mis-representation is there a different section for it. I am going to tell all the truth to the officer. ALready got 10 letters from my clients waiting for 5 more which should be a support for me.

              I never did anything will fully just a careless mistake and i want them to know that, that's all.

              Can you please explain permanent ban please,

                Permanent ban for misrepresentation falls under 212(a)(6)(C)(i) . I said that based on the rejection reason that you provided, 214b.

                It is very bad if it was under 212 as a waiver has to be requested from Stete department, some council has to look and the VO has to recommend that waiver.

                As yours was 214b, you are lucky.

                  Sounds much better now, So 214(b) is not a permanent ban i was very much worried since the immigration Official told me that he has added strong notes on my Case. I feel he still had courtesy for me since i returned without any violations in my first trip .

                  I am going to be as truthful as possible in my upcoming interview. I don't have anything to lie who i am and my motive for US visa. I hope the Official understands that,
