  • Coming into the US from New Zealand - Company Project

    Good day,

I am from Colombia (South America) and have been offered a job in New Zealand by an engineering consulting company. The company will request my work visa in New Zealand and I will be added to their payroll later on this year. The NZ company is a branch of a US company, and I will have to go to the US to get some training and work on some projects once in a while. I have however, only a B1/B2 visa to go into the US.

I would like to know if there is any problem if I go into the US to work on these projects with my current Visa. I believe a company can send and employee to work on projects in the US, but I just want to be sure.

    Thanks for your advice.

You cannot and shouldnot work on B1/B2 visa status. You could attend trainings but should not get paid by working. Daily allowance is allowed on B1/B2 and reimbursement of expenses is allowed.

Your company could try for a L1 visa for you if they want you to work in US provided you meet the criteria for intercompany transfer as L1 does not have quota limitations.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
