B1 status eligibilty

Hi,

I would like to know am I eligible for B1 Visa still being in U.S. I have got a gap between my L2 status to new H1 (oct).My spouse comapny is sending us back to india.

Anyone can apply for B2 but for B1, you need a business reason. You could apply for B2 COS but if it gets denied, you would be out of status.

While the application is pending, you are in status, but for the H1b COS to be effective, the B1 COS has to be approved.
