  • Have B1/B2 Visa, Wants to File Immigration Petition

    Hi,

I have a B1/B2 Visa. My brother is a US Citizen. If he files for my immigration, would impact my next visit to US on B1/B2 visa?..

I need to travel to US for my work & still have 7 years left on my visa.. But, I don't want the Immigration Petition to barred me from entering in US on basis of B1/B2 visa..

Can someone please guide me on what should I do?

    Thanks much for your help.

A newly filed mmigrant petition does not in any way effect an existing B1/B2 visa.

People have been able to get a new B1/B2 in the face of an existing immigrant peitition
when they have shown that the temporary need to visit US.

As long as you tell the officer at entry that your purpose and duration of visit are temporary, there won't be any issues.

Anyway an immigrant petition filed by a USC brother takes several years to materialise into a visa.
