  • URGENT: Passport Expiry within 6 months, B1 valid till 2020, can I travel to US?

    Hi All,

    Hope you are doing well.

Need the following information urgently. Any help appreciated. Thanks.

    - Passport Valid till Jan 26, 2013
    - B1 valid till 2020
    - B1 issued by a previous employer
    - Current travel required on behalf of new employer
    - Require to travel urgently to the US by Aug 06
    - Duration of Travel - 5-8 weeks
    - Purpose - Business Meetings

Can i travel under these circumstances without the risk of the following:
    - Refusal by Airline for boarding the flight
    - India Immigration asking me to go back
    - Deportation by US Immigration

As per my understanding, India is a part of the Carrier Liaison Program as per which:

"Visitors traveling to the United States are required to be in possession of passports that are valid for six months beyond the period of their intended stay in the United States. Citizens of the countries listed below are exempt the six-month rule and need only have a passport valid for their intended period of stay."

    Best Regards,
    Kunaal.

If your intended stay is only for 5-8 weeks you should be fine. Sometimes VO issue a blanket 6 Months I-94 while on a B1/B2 visit, but in case passport is expiring within the next 6 Months they issue only till the Passport Expiry date even with a valid visa hence you will not get I-94 beyond Passport Expiry date. This is my opinion not legal advice.
