  • Expedite Oath Ceremony for Humanitarian Reasons

    Hello all

I have a citizenship interview in a few weeks, if I am granted cirizenship, I plan to apply for a K-1 visa as soon as possible to bring my fiancé to the US and marry her. My fiancé lives currently in my home country Syria where a civil war is taking place and I am cery worried about her life. I've heared that there is a way to request expedited oath ceremony if there is a compelling humanitarian reason. My question, is the reason above suitable to request expedited oath ceremony? If so, what is the procedure to request expedited oath ceremony. Note that I live in Brooklyn, New York

    Thanks

    Hi,

First of all may Allah ease it on Syria and Syrian people.
Regarding your point of what you called expedite Oath Ceremony I haven't come across a point of such at all, I think once the Oath Ceremony date is set up it is there, it can be postponed but can't be brought earlier. Anyhow why don't you ask an immigration Lawyer he would give better answer but remember ask him what article in immigration law states or refers to such point of expedite oath ceremony.

Regarding K1, why don't you right now do your Marriage Contract (make a power of attorney to your dad or brother....) and let him do that for you, then file I-130 right away (K1 will take the same time as I-130 if not longer) and continue her immigration thru what is called consular processing path (once you get marriage contract she will be considered as your wife, immediate relative)...that may be easier and faster.

Expedite Oath Ceremony for Humanitarian Reasons

      Hi -

Thank you very much for your prayer and duaa brother!

From what I gathered online it does seem that USCIS has criteria by which petitioner could request expedition and among them is humanitarian and emergent reasons, I'm not sure if they would accept my reasons though, I will try and see what happens. However, are you sure immediate relative petition would be faster than K1? I was considering this approach as well but it seems that K1 is faster on average than immediate relative petition from what I could find online.

      Thanks again

        Hi,

Sure brother, Syria & Syrians are iin my heart and mind.
Again I am no idea if expedite oath is there or not, it is better if you just ask an attorney about this point.
Regarding K1 it will take about 9 months to get processed and approved, please see this link:

Also remember her file will take about one month more to get to US Embassy in Amman (US Embassy in Damascus doesn't take visa application right now).

I personally used the other option, US citizen files for his spouse (immediate relative) and the whole process (I-130, NVC processing, IV interview at the Embassy in Amman...etc) all took about 11 months. Frankly this 11 months could have been shortened to 9 months as my wife needed some Police Clearance Certificates from many countries and that is time consuming work.

Think about the immediate relative option and I am ready to pass you on my experience if you wish. Salam.
