  • applying for citizenship base on marraige

    Hello, I came to usa as CPR base on marriage on 3/2011 (2 years green card) i stayed in usa for 2 month and then I had to leave on 5/2011 until 1/2012 (8 month)
    I did remove the condition on my green card on 3/2013 and now I have 10 years green card and since 3/2012 I didn't left the usa (20 month so far)
    Do you think that I can apply for the citizenship on my 3/2014 ( 3 years base on marriage ) or even 3 month before the 3 year anniversary
    Or I can't because I was out for more than 6 month in the begging of my period? If not when should I apply?

    To qualify to apply for Naturalization under the "3-year rule," married to U.S. citizen, you must have been in the States at least 18 months during the last 3 years.

      Sorry, but I must add that the 8-month exit early in your Green Card history will receive special attention, and will require proof that you did not "abandon" you U.S. residency status, i.e, maintained a "domicile." Exits of more than 6 months don't necessarily break the "continuous residency" period, if you have a good explanation and maintained your U.S. residency in other ways.

        I would wait until late 2014 to apply, unless I could prove that my long trip didn't break continuous residence. Why were you out for 8 months?

          Hello
          I went to my homeland country and my wife get pregnant after 4 month out there there and we had to wait a couple of month because here dr refuse to give us a permission because she was in serious medical condition so we made sure that everything was good before we could fly back and it took us 8 month for every thing , so which specific date u think I should apply for citizenship ??

            Unless it's absolutely imperative to get citizenship as soon as possible, wait until December 2014.

                Why can't he apply on March + 1 day 2014, as he reentered on 03-2012 after his extended absence ( two years plus one day after his reentry from his extended absence )?
