  • Continuous Residency Question - Interview in December 2014

    Hello everyone,

I would like to clarify couple of things regarding 5 year Continuous Residency Question and I am scheduled for Interview in December 2014. I will try to keep it simple and short. I am a permanent resident since December 2005. When I got my green card I was studying in the UK and therefore, I use to visit US for a week or two once in 11 months. I did this from Dec-2005 to Oct-2008 until I permanently moved to the US in November 2008. Just to make it clear I never had to ask for re-entry permit since I use to visit US once in 11 months.

I applied for the US citizenship in August 2014, which is more than 5 years of continuous residency requirement. I was confident up until I got the Interview Check List N-659; which says "If you have taken trip outside of the US that lasted for 6 months or more since becoming a Permanent Resident" then one should provide proof that "you did not abandon your residency or terminate your employment in the US nor abandon your US abode".

My question is why they want to know trips of more than 6 months since becoming a resident? Is this a problem for me even though I am well above 5 years continuous residency requirement? If that is the case I do not think I can ever apply for the US citizenship since USCIS is looking for 6 months period since becoming permanent resident so having 5 or 10 year continuous residency is of no use in my case. I am just thinking loud.

I appreciate your any feedback and you time to read.

    Thank you.

I was in a very similar situation. I moved here from the UK and got my green card in '92 and did a similar thing you did for 4-5 years.

Had my interview today and was approved. Ceremony in January!

So stop worrying! They just like to ask questions on the forms. The interview is a piece of cake... or biscuit.. whichever you prefer

      Congratulations Steve!!!

I went through my interview but decision was not taken. so I am just waiting at the moment and hoping for the best. You can go through my recent post and it has more details. I was planning to get married to my Fiancee in February but I had to push the wedding plan to March and all the plans had to be canceled and hoping for the best. Applying through green card will take atleast 3 years so this has put me in very tricky situation. I will keep you all posted and may be able to help someone who has to go through the same situation.

      Have a good day.

      Mistry.
