  • N400 - Tax Return Question

    Hi Folks,
    I was wondering if anyone else has had this experience.

    I am about to file my N400 on the basis of being married to a US citizen. I'm applying within the 90 days before my third LPR anniversary which comes up in Jan 2015.
    It says I have to submit 3 tax returns. I have two returns from the first two years of being here. Obviously I can't give them the future one yet.
    So...

    Should I submit the N400 with the two previous years returns and that is sufficient? Are they simply making sure I am not evading taxes?
    or
    should I wait until I have complete the third tax return sometime early next year? (I'd rather not wait until then).

    I'll also add that they were filed jointly so that isn't an issue.

    You have ben in usa 2 years so just send the 2 years tex is not a problem

      There is no requirement that you must include 3 years of income tax returns with your N-400. You are expected to include copies of all tax returns that were submitted as jointly filed, or by you alone (the latter as proof that you filed an income tax return). Including tax returns or transcripts is not an income test, but simply proof that you and your husband commingled financial affairs and that you are meeting your legal obligation to be reporting your earned income to IRS.
