  • Abandoned previous application - will it be a problem applying this time?

I was once married to a usc. I got my green card. But our marriage went sour when we were almost 3 years together. I applied for naturalization , submitted requirements, and got my biometrics appointment Schedule.

But our relationship did not get better. and i started looking for a job at a different state. Out of good faith , since we were no longer in good terms by then, i was conflicted to still pursue the application that i didn't go to the biometrics appointment.

Its been over a year. I am now in another state , with a different job, and divorced. My 5 year mark is also coming soon And i will be eligible to apply for naturalization again.

Will my previous abandoned application be a problem this time?

When you reach 4 years and 9 months from start of first Green Card, apply again for Naturalization.

Yes, i will apply again. i will reach 5 years this year, in December. But I'm thinking of my previous application that i abandoned if it will be brought up, questioned , and cause complication.

Have you removed the condition from your residency? When you first got your green card, that should have been conditional greencard with expiration date of 2 years. Did you remove the condition? If yes, then you shouldn't have problem applying after 4 years and 9 months provided you satisfy the continuous residence requirements. If NO (which I doubt) then you probably are out of status and will need good lawyer.

So, if you have removed condition, file N-400 after 4 years and 9 months from date on your first Greencard.

          Yes, condition was removed.

I will be a perm resident for 5 years this December, plan to apply in October. Just worried they would dig up my N400 application that i abandoned when i reached my 3-year mark and theyd make a big deal out of it, giving me a hard time.
