  • N-400 and Tax Returns

    Hello,

    I will send out my N-400 application next week under the 3-year married to a U.S. citizen rule.

    I know that I have to send the tax returns for the last 3 years with the application. I did not file for taxes in 2012 and neither did my wife because we both had no income in 2012. I explained everything on a separate sheet of paper. Do you think this is sufficient or is USCIS going to give me a hard time about not having filed a 2012 tax return?

    You said, you both did not have income that year and will be sending a note of explanation. That should be sufficient and if you have an proof you could go ahead and submit that also.
    Regardless, I see no reason why they would give you a difficult time. Good luck and congratulations!!
