Hi All,
I am hoping you guys can confirm and advise my situation.
I am a Canadian Citizen and my wife is an American Citizen. We have been married for over 15 years and my wife moved to Canada to live with me. We have decided to move back to her home in the US, and I would like to apply for my green card.
We had a family immigration lawyer gives us what I believe to be false advice..He said you cant do anything until you are here for 3 months. Well unfortunately right after 3 months passed I lost my father and had to go back to Canada. I am now back in the US and my lawyer says we need to start the 3 months over again.
I have read what I believe is the law that Canadians(unlike other nationatilities) dont have to prove entry into US. As I have entered legally without a visa as I dont require one.
Is the process as simple as filing the I 130 and the I 485?
Our lawyer it seems isnt familiar with green card for Canadian spouses and he specialized in illegal Mexicans coming into the country to marry. I appreciate any advice and guidance that anyone can provide
