  • Simple Assault Case Dismissed - Does It Impact My Citizenship Application

    Hey Guys,

I'm glad to find this great forum. Got a question on my citizenship application. Really appreciate it if someone could give some suggestions.

I have my green card since about 9 years ago. In 2013, I was arrested and charged for simple assault. The case was dismissed and I was not committed in any way. The arrest record was expunged as well.

I know that I need to disclose this record in N400, but I'm not sure how this record can impact my application. Can someone please let me know? Do I have to hire an immigration attorney (as you all know they do charge a lot...)?

    Thank you in advance!

    Best.

Only the officer interviewing I believe can make that determination. Let's just say I had a case close to 20 years ago I had to go to the court for and it was more serious. While it's 2013, and you absolutely have to disclose it, personally to me it wouldn't be a huge issue. We are not talking about a felony here which would obviously automatically disqualify you. As long as you can show that you're a good person in nature otherwise I'm sure there shouldn't be a huge issue. Good luck

Thanks a lot anon2016. Do you know how I should present this incident in N400? Do I need to attach the dismissal paperwork?
