Hi Ray,
During a 12 months window during the 5 years qualifying period, if a person undertakes two overseas trips - one for 5 months and one for 2 months, will it cause a break ? Strong proof of US residence is there for all 5 years in the form of house ownership and bank accounts, family in USA etc. While each trip is less than 6 months, together it is 5 + 2 = 7 months. Is it one single trip of more than 6 months which brings in discretionary power of officers or all trips combined > 6 months which triggers discretionary powers to play ?
Your reply will be highly appreciated. Thanks.
