  • Born Aboard No birth certificate

    Greetings,
I would like advice regarding my situation (outside of "seek an attorney").

Both of my parents are American born citizens who lived overseas in Nigerian from 1979- 1982. I was born in a Nigerian hospital but do not have a birth certificate issued from the hospital or the Nigerian government. My parents did not register my birth with the US Consulate or Embassy. I came into the US as an infant on my mother's passport.
I do not have relatives or contacts in Nigeria.
In 1994 my parents had a family friend get a certificate of birth from Nigeria; which was issued 13 years after my actual birth.

The US does not have record of my birth and no consular report is on file.
I applied for a US passport in 2007 and was denied due to no birth certificate. With the passport application I provided
    the following documents:
    Parents birth certificate
    Father's death certificate
Affidavit from my mom with history of address
Affidavit from my mom in lieu of marriage certificate
Certificate of birth issued in 1994 (not from NPC but from local government)
    NC drivers license

Since then I have gathered the following additional documents:
School records (I've only went to school in the US and most of my elementary and middle school was in the same state and county)
    Immunization records

My parents did not have a marriage certificate but my mother is a US citizen and my father is deceased so I'm not sure if that is important or not.

From my understanding I acquired citizenship at birth
    A. General Requirements for Acquisition of Citizenship at BirthA person born in the United States who is subject to the jurisdiction of the United States

    and
the Nigerian government did not mandate the registration of births until 1992

I would like to know 1) if I need to get a certificate of citizenship (form N600) or if I can try to apply for a passport again and use more secondary documentation?!
If I apply for the certificate of citizenship (since I do not have a birth certificate) will the documents I have suffice?
Lastly, should I do a DNA test to prove my mother is my biological parent?

    Thank you kindly!

    Update!!

I was able to obtain my passport and did not need a Certificate of Citizenship (N600).

I used the oldest public records (immunization records, early school records, etc) and affidavits from my mother, uncle and brother who all were present and/or aware of my birth.
In addition, my mother and I did a DNA test. I applied for my passport the end of July and received the passport this month (November 2017). The process took 4 months and some of that delay was due to process timing of certain certified records. Please note; you must wait for the State Department to request you to take a DNA test before going through with it. The test is expensive and the lab will require the letter you receive stating DNA is needed.

Now I can use the passport to get the N600 if necessary. Since my original post the cost of the Certificate of Citizen has doubled, so I will not be applying for one, being that a passport is proof of citizenship.

I hope this information helps anyone who has a similar story.
