  • Question about Naturalization

Hi, I am a Permanent Resident( Green-card holder) since 2003. I left US for more than 1 year and I know that my Naturalization Eligibility stops because of that. Do I need to wait for more 5 years to start the Naturalization process?

If you were away from the US for a single absence of more than 1 year, you qualify for naturalization 4 years and 1 day after returning from that absence (if you are qualifying under the 5-year rule) or 2 years and 1 day after returning from that absence (if you are qualifying under the 3-year rule).

This is my personal opinion and is not to be construed as legal advice.

Wouldn't this be considered abandonment so it would definitely affect your ability to naturalize!

The fact they let him back in the US means they determined he didn't abandon residence.
