  • Got Green Card on L1 Visa, but have been married to USC for 3 yrs, ok to apply?

Hello, I hope someone can clarify this for me, I have been a permanent resident since 9/28/2014, before that I was under an L1 Visa, my employer sponsored all the process for my Visa and Green Card. I got married to a USC on March 9, 2015, so Im about to come up on our 3 year anniversary (minus 90 days). Would my naturalization process be a straightforward application of the n-400 form? everything Ive read is from people that got their green cards by getting married to USC and that was not my case, just want to clarify if there is something else I need to do?

Ive asked some people and have gotten mixed responses, someone even told me I will need to wait for the full 5 years? however when I did the eligibility worksheet it says I can apply now.

    Any help is appreciated!

3 years it is, even though you did not acquire permanent residence through marriage. See https://www.uscis.gov/policymanual/H...-Chapter3.html

You need to have been married to a USC for 3 years before you apply. Not 3 years minus 90 days. The 90 days early is only for the (5 year or 3 year) continuous residence requirement. All other requirements must already be met.

This is my personal opinion and is not to be construed as legal advice.

wow thanks so much for clarifying that, I feel my case is backwards and couldn't find a lot of details on how to handle. Now I know and I will file until march 2018.
