Need Answers to N-400 After Register to Vote

  • Need Answers to N-400 After Register to Vote

    At interview IO presented me with a paper that said that i had registered to
    vote on Dec.2001. I was not aware that I was registered to vote. Have never voted.
    Had my name pulled from Voting rolls and sent it to Immigration office.
    Was denied on Oct.2012 due to "Bad Moral Character" at this time"

    It's been more than 5 years and I'm getting ready to file again.
    Do I answer Yes or No to the following 2 questions in N-400?

    1st Question:
    "Have you EVER registered to vote?
    In the last 5 plus years, I have not registered to vote.
    So what should be the answer to this question? Yes or No?

    2nd Question #32 asks the following:
    Have you EVER lied to any U.S Goverment officials to gain immigration
    benifits while in the United States?
    Well, it seems like I did lied on the whole regestering to vote thing.

    Anyone who has gone thru the same please tell how to go about
    answering this questions, I will greatly appreciated.

    And to top it off, my GC expixes on Dec.2018

    My guess will be to answer yes to both of these questions, since it states
    Have you EVER?!?!?!...But God knows I need all the advice I can get. Thank you all.

    The biggest problem with registering to vote is not the actual registering to vote, but rather, a potential false claim to US citizenship. Registering to vote almost always requires you to sign something (even if accidentally) that says you are a US citizen, and a false claim to US citizenship makes you deportable with no waiver, and gives you a lifetime ban with no immigrant waiver. (Registering to vote does not by itself have these consequences.) But it's interesting that they found out about this in 2012 but haven't put you into deportation yet. Maybe that means they couldn't find evidence that you claimed to be a US citizen when you registered to vote.

    For "Have you EVER registered to vote in any Federal, state, or local election in the United States?", the "EVER" means forever, so the answer would be Yes if you had registered to vote (no matter how long ago). Did you ever figure out whether you actually registered to vote? Or was it a mistake in the voter system? Did they give you a copy of any form you signed to register to vote?

    Note that there is another question "Have you EVER claimed to be a U.S. citizen (in writing or any other way)?", and if you have claimed to be a US citizen you would have to say Yes, although in that case I would suggest you not apply for naturalization or at least get lots of legal advice first because it will probably lead to deportation.

    For "Have you EVER lied to any U.S. Government officials to gain entry or admission into the United States or to gain immigration benefits while in the United States?", that would be No (unless you have some other instance of lying), because registering to vote is not an immigration benefit, and voting is handled by state and local officials, not US government officials.

      Can some help find Webb815 thread, he/she "mistakenly register to vote", was denied just like I was, and later applied again and is now naturalized.
      I know every case is the same, but this his/her sounds pretty much like mine.

      And no, they never gave me the registration thing that might have been signed.

        Can you share which office you had applied to? And if you were registered in the same city as the office?

          Depending on the state you are in, it could happen that you were registered at the DMV when you got your license. This is a very bad system for immigrants, who may register or be registered without necessarily being aware of it. I am not sure if you should say yes or no. You should ask a lawyer. HOWEVER, I strongly urge you to find out exactly how you were registered and then write up an explanation and emphasize that you DID NOT register yourself. If you can get proof, for example a policy that says people are usually registered when they do certain things (like get a license), that may help a lot and show that it was NOT YOUR FAULT. And emphasize that you have never voted or misrepresented.

          Several states have passed legislation to implement automatic voter registration, where voters are automatically registered when they go to the motor vehicle agency unless they opt-out.


          (Automatic voter states require you to affirmatively opt OUT of being registered)

            The DMV registered me to vote when I renewed my license and I specifically didn't check any boxes for that.

            Luckily the actual registration happened 6 days after my oath.

              Denied n400 and appeal due to registering to vote

              Hi,
              I have kind of a similar case. Someone made me register to vote at a social security office and I told them I am not a citizen and she said it?s no problem ( I didn?t know better). I applied for the n400 and checked the box for have I ever registered to vote. At the interview the interviewer asked for more paperwork, so I went to the voting office and got my name removed and sent them the proof that I removed my name. But I got denied for ?bad moral character?. I made an appeal and got denied again. When should I reapply? After how long? All this was in 2018

                It is terrible when this happens. In some states, there is a lot of voter fraud. One of the areas is the DMV. They automatically register you to vote! Be careful and donot allow this.
                I have heard both results. For some officers it is no big deal. Once explained and explanation letters written, they pass the applicant. For other officers, it is a different story depending on how the applicant was registered and if the applicant actually voted after the registration.
