  • Filing N 400 with city ordinance violence

    Hi,
    I'm very worried about my N-400. I've had a city ordinance violation back in 2004 and got my GC after that. Declared that in GC and explained what happened in GC interview. no issues with GC. Now I'm eligible to file for naturalization and wanted to ask how I should answer the four questions in the form. Questions 22-25 in form N-400. in 22, I said No. 23, I said Yes. 24 - Yes. As far as 24 and 25, I'm confused. I talked to the court clerk and she said it's not a criminal charge or misdemeanor. It's simply a city ordinance violation and I was fined $75. Charges were disposed (not dismissed) once fine was paid. Please advise. I got the court disposition documents.

    How do I answer the the questions 24 and 25? I'm supplying all supporting docs.

    I am so sorry, but it is hard to answer your questions because I am not a lawyer.

    We can not give legal advice, and yours requires some answers with serious repercussions if you are not truthful. Don't lie. For #23, even people who have had traffic tickets answer "yes" and have to explain. Number 24, just answer to the best of your knowledge. Number 25 is a serious question. You either were convicted or not. Tell the truth. Look up the word convicted in the dictionary and if it does not describe your situation, answer accordingly. When in doubt, ask a lawyer. If you have no money to pay a lawyer, go to Catholic Charities in your area. They have staff that will assist you with the N-400 and a pro bono lawyer that they work with.

        Like the clerk said: "Its not that serious." Just answer truthfully.
        Possibly you can call Catholic Charities to assist you. They provide free advice and services.
