  • Waiting for RFE after n400

    Hello

I hope someone will be able to give me some insight about my situation. Any information will be very much appreciated!

I had my n400 interview about 4 weeks ago. I passed the tests, but the IO officer gave me the paper saying that the decision could not be made at that time.

I am divorced and the only only divorce document I brought tot he interview was a divorce decree decree. I didn't expect that the officer will ask for all divorce papers. He said he would issue an RFE very soon, but I am still waiting. I called USCIS a couple times, but was told to keep checking the website. I am very nervous due to several reasons. I am going out of the country for a few weeks soon so I won't be able to mail the papers back when I get RFE. Also, is it normal to wait for RFE for a long time after the interview?

And finally, my ex-husband is a little crazy. We divorced because he was abusive and violent (there is a very strong evidence for that, I presented it to the IO as well). I am sure he wrote a lot of long letters to immigration asking to deport me (IO asked me some questions that made me think that)

I am just overdoing it or should i be worried, that i still didn't get an RFE?

    Thank you for reading!

Hi RIIK, I hope hearing about my case can help ease your nerves (I don't think you should be worried)

I had my Interview on August 15th, 2017 and also "a decision could not be made at the time". My IO was really friendly and at the end of the interview told me "You should have a decision from us within 120 days, but hopefully it won't be that long!" ..... Unfortunately it was. It was 244 days before I received a RFE notice and they gave me 30 days to respond to it. It was been 75 days since I responded and I'm still waiting to hear back again. I think they usually give you a few weeks time to respond, mine was 30 days (I don't know how long your trip is), but every case is different.

If I were you I would try to guess wich documents will they ask for, maybe do some Google research so that you can start preparing any certification/translation you might need and have them ready. Make sure you have someone getting the mail for you when you're away as I been told by several sources that the website is not updated very often. In fact, my case still shows "scheduled for interview", it doesn't show anything about my RFE.

My lawyer says this timeframe is still considered "normal" because according to the website my case is still inside the "USCIS Processing Times". Unless your case is outside this time frame there is not much you can do. (ie. they tell you to keep waiting everytime you call) My case is going on 18 months now but Atlanta processing times show 10.5 to 20 months, so technically my case is still "normal".

I hope your wait is not as long as mine, again, every case is different. Keep us posted =)

Hi, Are you still waiting? I sent my response to RFE a week ago. I wonder how long I will have to wait.
