  • Have 9 years of permanent residency. File under marriage & 3 yr rule?

Hi, I received my gc 9 years back and married for 13 years. My husband got his citizenship 4 yrs back.
When I started applying online N400 as 5 year permanent resident, application changed to 3 years & married. It is giving me an option to override. We are in VA and I don?t know which will be the better way to apply. If I override the option, will it become an issue?

Seeing prior forums, feels like 5 yr residency seems best option. But is it faster to get through marriage?
My gc renewal is due next August, so looking for best option. Thanks!

have you satisfied the residency requirement (no long trips out of the USA) for the past 4 years? if yes, better apply naturalization based on your own permanent residency.

Else your spouse would need to attend the interview as well.

Yes, I was out of country for only 66 days in past 5 years.

Is applying through marriage is faster? Not sure about the implication if I just apply/override to 5 year rule.

If you qualify under both the 5-year rule and 3-year rule, then definitely just apply under the 5-year rule. It is simpler. There is no reason one would be faster than the other.

This is my personal opinion and is not to be construed as legal advice.

I agree with NewAcct the 5 yr application is going to be your best option
