  • Helping out refugees

    Hello everyone,

I have a question regarding N400. I am volunteering at an organization that helps green card holder refugees go through their naturalization process.

My question is for a husband and wife and two kids, do they need to file separate N400 forms, if so what about the kids? They don't make a lot of money and I already told them about the I912 and I942 but it would be nice if they could file together for saving even more money.

When I googled it it says separate but I wanted to make sure.

    Thanks!

Each adult files their own separate N-400. Only adults can apply for naturalization with N-400. Kids under 18 cannot apply for naturalization. However, if either parent becomes a US citizen before the child turns 18, the permanent resident child automatically and involuntarily becomes a US citizen under INA 320, without needing to file anything.

This is my personal opinion and is not to be construed as legal advice.

Thank you for the answer! I have yet another question.

Some of the students I am helping are married however they do not have marriage license or certificates. They got married in a village hence no official papers.

They have refugee status however I was wondering if the IO would want to see their marriage certificates for any reason? If so is there a way to legitimize a marriage without a license?

      Appreciate all the help!
