  • 3 month residence requirement for Naturalization

    My personal details: I recently moved from California to another state. I am currently staying with a friend and gave her address as my permanent address. i will reside in this address for 2 months (sometimes traveling out of the country)

    I will lease my own place in the same city/state starting September at which point I will change my legal address once again.

    Please help clarify my 2 questions which are as follows:

    1. Will the 2 months i stayed at my friend's place count towards meeting the 3 month residence requirement to applying for naturalization? Basically I want to apply for my Naturalization 1 month after I rent my own place.

    2. Is the 3 month residency requirement a "Physical presence" requirement? from what i read, i need to reside but not be "physically present". Am i reading the rules correctly?

      I think thats kind of rude to say..........if you think the post is stupid, why not simply ignore it rather than insult the person? We should attempt to be civil and respectful.

      My advise would be to wait the 3 months until youre physically in the state before you file......to avoid any complications

        1. simple math -> 2 month is not equal to 3 month
        2. yes, you have to be in the residence for the 3 month period, not simply have "leased" a place and live somewhere else
        sorry, you need to either work out better or postpone your filing until you're ready to live in one place

          You must have been living in a state legally for 3 months. If you have been working in CA and have been paying taxes, that would count, though having a lease to an apartment or some such would be easier to verify.

          Physical presence within the state for three months continuously is definitely not required.... You may be going out of state to work or a holiday does not reset your 3 month clock.
