  • Wife moves before interview...

    Hello friends

We have a unique situation. We have filed for N-400 in May 2007 and have got fingerprinted. Now my wife has found a job in the Chicago area and will have to start work mid September 2007. We are very scared as to what the impact of this move would be. If anyone can give us some insight, that will be really great...Here are the situations

    1. Interview happens before say Oct 01 2007 and she takes the interview when she is working for the same employer (that means nothing on N-400 changes). She then moves over before oath.

    2. We won't be able to get to the interview before she moves to chicago. The employer and current address for her would change, but I would continue to reside at the same address. What is the impact of such a move? What should she answer when the interviewer asks whether anything has changed in the N-400 since filing?

    Any help is truly appreciated...

When an application is sent, the 3 month residency rule is sought, if your wife moves to a new state, the best thing to do is to keep your house in your current place and that way you will still be a resident of that state. Otherwise, you would need to send INS your new address, if the local office is the same for the new state, no problem, your aplication moves along. If it is a new local office, then INS sends your paperwork to the new office, worse case scenario you may need to show 3 month residency in the new address. So it may delay your application by a couple of months, but you surely have the right to move and work wherever you choose as long as you let INS know. Hope this helps.

I am not moving. I will be here till we get our citizenship. She will come here for both interview and oath. In that case, she does not need to inform INS in her interview...right? Please advise.
