    Hi,

    My nieces aged 11 and 7 have been living with their grandparents in India for the last 5 months due to certain unavoidable circumstances. Their mother is due to receive her citizenship next month and we are hoping that the children will receive theirs when she gets hers. Now my question to you is - do my minor nieces have to be physically present to be eligible for citizenship when their mother receives it in December?

    Children do not need to be present when their mother receives citizenship. As far as her children concern:
    If children born in US or born abroad to an US citizen are, consider US citizen at birth.
    If this is not the case, then alien parent (s) who naturalize after the child’s birth is consider US citizen.
    You (all I am referring to parent) need U.S. passport for the child as evidence of citizenship.
    You do not need a Certificate of Citizenship certificate issued by USCIS to get a passport for your child.
    If you want, you may request USCIS to get certificate for your children’s US citizenship and/ or passport from department of state.
    If children immigrating under ’IR-3’ or ’IR-4’ categories must have an immigrant petition filed on their behalf before their 16th birthday. In addition, the one U.S. citizen parent rule applies to children who were under age 18 on or after February 27, 2001.
