  • Regarding the education in India of a minor US-citizen with OCI-status

    Dear friends,

I work in the U.S., and shall soon be eligible to receive the U.S. Citizenship. My son is twelve years old and is currently studying in India. After receiving my Naturalization Certificate, and I shall apply for the U.S. citizenship for my son. After receiving the U.S. citizenship for my son, I am planning to apply for the Overseas Citizenship of India (OCI) for both of us, and then to return to India. My son has all along been studying in India and I would like him to continue his studies in India until he completes a bachelor's degree. I would like to know as to whether:

    1. My son can continue to study in India as a U.S. Citizen with OCI-status.

    2. My son would be eligible to apply for universities in India as a native Indian student as a U.S. citizen with OCI-status.

Please give your suggestions and advises as to whether he could apply for admission to Indian Universities as a U.S. citizen with OCI-status.

    Thanking you for your help,

    Regards,
    Gopalan

    Same situation Please help

    Hi Gopalan,
I am in a similar situation like you and want to know some details please help me. Below is my situation

    1. I will become eligble for Citizenship In July 2010.
    2. My Son (now 12 years old) born in india is a green card holder and lived with my for 9 years in USA with me.
    3. He is studying in India for the past 2 years and he comes to USA every year for 2 or 3 months for his vacation and so his green card is valid.

    My Question is
    1. Once I become US citizen can I ask him to come to USA on his green card and once he comes into USA can I apply for his US Passport ?

    2. Once he come here can I apply for N600 and both of us leave the country ?

Hmm, In my opinion, there are few points to consider...
      a) As soon parents become US citizen, their kids below 18yrs old will become US citizens by default.
      b) As you mentioned you can get OCI for yourself & kids.
      c) Your kid can study in India as long as you want with US citizen & OCI status. But the catch is your kid is always considered as NRI. So, NRI fee will be applied in any school that you go to, which is I think 3times the normal fee if the kid was a Indian citizen.
