  • time frame to apply

    My husband and I have been married for almost 5 years now. I received my first greencard on October 18th, 2006 and my second card in January of this year.
    I was told that I will be eliggible to apply for citizenship in 3 years from my first greencard. Is that correct? If so, can I apply starting with the date of my fisrt greencard (October 18th) or is there a time frame before or after that date?
    Thank you

    Assuming that your husband is US citizen.

    The first Green that you received was conditional resident card.
    The second card that you received is you permanent resident card ( conditional removed ). your eligible to apply for citizenship, 3 yrs from the day you received your second green card. If you received your second green card on January 2009 then your eligible for citizenship after october 2011.

    this is not a legal advice . you can also check your eligiblity on USCIS website.

      Are you sure?I was under the impression that I would be elligible to apply after 3 years of becoming a resident(strating date would be the day I got my first greencard)
      Can anyone confirm? Please...I want to make sure we do the right thing.

      Thanks

        If you are at least 18 years old and:
        Are currently married to and living with a U.S. citizen;
        and
        Have been married to and living with that same U.S.
        citizen for the past 3 years;
        and
        Your spouse has been a U.S. citizen for the past 3 years.

        3 years as a Permanent Resident without leaving the
        United States for trips of 6 months or longer.

          Hi! I have read your post yesterday and wondering what is the real time frame... well, this is my experienced... according to saint_usa.. that's what I did on my application for naturalization... I got my citizenship BUT my son have the same situation like yours and his immigration lawyer said that he can apply for citizenship after 1 and 3 months of his permanent green card....I am very confident with our lawyer, he is a former immigration officer here in Orange county...So we decided just to leave it to our lawyer the application for naturalization...Good luck!

            Hi, I just went to the interview for citizenship last Monday, and I can tell you for sure that your residence starts to count from the moment you receive the conditional resident card (the first green card, not the second one), so it appears that you are ready to apply for citizenship! Trust me, I applied for residence through marriage and received also the conditional green card, so I know what I am talking about.

            Good luck!
