    Hi,
    I have been married twice. First marriage ended in divorce in 98. Second time I married in 2005. My GC is completeting 5 years in the end of September (employment based). But, she turned out to be few of those con people who would go any length of lie and deciet to get US Green Card/citizenship. I just didn't want to help any con artist and be in trouble later. So, I started my divorce proceedings from US (she lives in another country and never been to US) in January, 2009. The divroce process is taking a lot of time because corrupt system there won't send me the confirmation of serving the court's documents to her. So, I have the following questions:
    1. In the form N-400 in Part8 section B, should I fill out any information about my second marriage?
    2. If the answer is "NO" then subsequently, in part8 section F, question 5, should I choose my answer as "Other" and then mention as "Divorce Pending", and attach the documents of court filing?
    3. Can N-400 be filed 3 months before the 5 years completion of GC? I couldn't find this specific information on USCIS website.

    1. Since you are currently married, then yes you should include information about your current marriage on the N400. You are considered married until your divorce is finalized.
    2. See above. Note that if you finalized the divorce after you are approved but before you receive your certificate you should let your immigration office know so that they prepare certificate or update the certificate (if already prepared) with your current marital status.
    3. Yes, you may submit the application up to three months before five years have elapsed since receiving your GC.

      Thanks for your reply! But, would I have to carry the divorce filing papers to the interview to clarify about the current status of the marriage?
