  • When I can apply after I continuous residence?

    Hi,

I have a green card since 2014 (through my wife), I applied for n-400 in Feb 2018, but I got denied because I have a trip more than 6 months in 2016, since Nov-11-2016 I never left the country.
My question can I apply in Aug-11-2019 (I read I can apply 3 months earlier) or I have to wait exactly 3 year which is in Nov-11-2019?

You can technically apply 2 yrs and 1 day after your last long trip...Nov 12, 2018, but what I understand is not all IOs may know this and if you get the wrong IO, its back to another cycle of denial & appeal.

It is safe to apply 3 years minus 90 days from Nov 11, 2016. This is 8/13/2019, not 8/11 as you calculated. But I'd give it an extra week to make sure you're not caught in a date math issue.

I know about 2/4 years plus one day rule, but I read a lot about it, it's not clear if it applies to me, because I broke my continues residency by a trip less than a year.

      Thanks for the answer.
