  • N-400 Submission

    Hello everyone!

I submitted my N-400 application (based on my marriage to a US citizen) last March 15, 2010--Dallas, Texas.

I checked the status of my check and found out that they encashed it yesterday, March 24, 2010.

Does anyone have an idea as to when will I receive a NOA, like a time frame at least?

I have another question: I got my Greeencard June 14, 2006 and I travel almost every year
    2006 for 3 mons
    2007 for 5 months
    2009 for almost 6 months.

Will this affect my case? Can anyone pls enlighten me on this matter? Appreciate it very much!!!

If all the trips combined in any calendar year is not more than six months, you should be fine.

      Hi pokerface,

I am going to clarify for you and somebody else.

      The requirements for naturalization are:

      - A "continuous" resident of the U.S. for at least 5 years (3 years of "marital union" for certain spouses of U.S. citizens) counting back from the date of your application. Absences from the U.S. of less than 6 months shall not break the continuity. An absence from the United States of more than six months but less than a year creates a presumption against you. . YOU SHOULD BE FINE ABOUT CONTINUOUS RESIDENT.

      - Physically present in the U.S. for 1/2 of the five years (or three years). You must actually be in the U.S. for 913 days (or 548 days if a three year requirement) during the five year period counting back from the day your file for naturalization. Note that some spouses of U.S. citizens who are or were employed outside the U.S. have no residency or physical presence requirement. This means that the spouse can get his/her green card, and then your citizenship, almost simultaneously!. SO IF YOU FILLED ON MARCH 24, 3 YEARS BEFORE IS MARCH 24 2007. YOU SPENT 11 MONTHS OUTSIDE USA. YOU ARE OK BECAUSE IS LESS THAT 15 MONTHS REQUIREMENT OF THE TOTAL 30 MONTHS.

      - Continuous residency in the State or INS District where you are applying, for 3 months prior to filing the petition for naturalization.

MI ADVICE IS Don't make anymore trips abroad DURING YOUR PROCESS.

      Hope this help.

      Good luck

NY Applicant - NOA received (3/27/2010)

Thank you so much ICEWAY and HELPWITHH1 for the helpful response.

I received NOA today. Hopefully the schedule for my FP will come soon.

For all those New Yorkers who were recently naturalized, if u can post/share your timeline as a guide for all of us who are still in the process of getting our citizenship, appreciated much...thanks in advance!!
