  • fingerprinting rejection

    My first fingerprints were taken on February 9th, 2010. It was rejected and the second manual was sent to the FBI on February 10th. On March 5th,we found out from the application support center that the second set was also rejected. However, we still havent officially heard from USCIS that the second fingerprints were rejected. How much time does it normally take? What course of action can I take?

    I think you should read the M476 A Guide to naturalization:

    From there:

    " If the FBI rejects your fingerprints twice, you will be asked to provide police
    clearances for each place you have lived in the past 5 years. You will need to contact the police departments in the places you have lived to get these
    clearances. "

      Thanks. I am aware that I will have to provide police clearance certificates from all the places that I have lived during the past five years. However, the issue is that I still havent "officially" heard from USCIS that the finger prints were rejected. We were "unofficially" told that the prints were rejected the second time by the person at the application support center who took the fingerprints.

        I just found out that if the second fingerprint sets are also rejected by FBI, USCIS will not send a notice indicating the rejection. Rather, they will still schedule you for an interview and during the interview you will be asked to provide police clearance cenrtificates. You will probably have 30 days to furnish that information. You could obtain the police clearance certificates before the interview in which case you might not have to wait for another 30 days after the interview to recieve a decision.

          what state are you applying?.

          By the way, what is exactly "police clearance certificates". Where can you get that?. I don´t know if you are talking about a "police clearance letter" that you can get from California Department of justice (I am applying in California).

            Hi,

            First of all, you should get a RFE for unclassifiable fingerprints. I read in different forums that you shoud receive a letter from USCIS which stated that you need to submit "a five-year certification of good conduct/police clearance from the local law enforcement agency such as the Police department or the Sherriff's office". COURT CLEARANCES ARE NOT ACCEPTABLES.

              Hi flipflop,

              I live in Virginia and I applied to the Texas service center. Police clearance letter (or certificate) is a certificate issued by the local police agency which states that you dont have any criminal records in that city/state. You need it only if your second set of fingerprints are also rejected by FBI. You need to furnish this information for all the places that you lived in during the past 5 years. If you have moved within the past 5 years, you need to call the police department of each place you have lived and ask them to send you the certificate. Each city's police department has different rules and regulation. Chesapeake police department charges $5 (but issues it within 15 minutes), Pennsylvania have an online system where you can pay $10 and download the certificate immediately, etc.

              BTW, the fingerprint rejection was my wife's. I applied at the same time, but I have already finished the interview. I submitted the initial application on January 15th, 2010, and the interview (which was in Norfolk, VA and lasted less than 10 minutes) was on March 30th, 2010. My oath ceremony is scheduled for May 6th.

                Thanks for the reply. The fingerprints that were rejected were my wife's. We submitted the N400 application together on January 15th, 2010. I had my interview on March 30th, 2010. I got the oath letter immediately. After the interview I asked the interviewer about my wife's case. She checked on her computer and told me that I would not get any RFE from USCIS about the second rejection and that the next notice would be the interview notice.

                The interviewer also told me that we could obtain the police clearance certificate without actually having the RFE notice in hand. We have already obtained certificates from 3 of the 4 places that we have lived during the past 5 years. I hope to get the last one next week.

                It is possible that the interviewer was mistaken. It will be one month since the second fingerprinting and we plan to go to the local field office (using an infopass appointment) to enquire about her case.

                    So I think that it depends of the state you are applying because I know some people that received a rejection letter.

                      Hello,

                      I just learned that my first set of fingerprints have been rejected. I have a few questions to those of you who had a similar experience.

                      1. How long did it take you to receive the second fingerprint notice from USCIS? Was there an update to your online case tracker before the second notice was sent?

                      2. In your opinion, how long does the second fingerprinting delay the processing of the application?

                      3. If the second set is also rejected, did anybody try to take a police clearance certificate directly to the interview? If so, can you get an oath letter on the same day?
