  • Is employment needed for Naturalised Citizenship from a GC and questions on N400

After 5 years of having the Green Card I am ready to apply for naturalised citizenship.

I have had on and off employment for this period am currently unemployed. Do you need to be employed to apply for Naturalised Citizenship from a Green Card.

    Questions on N400

    48. If the law requires, are you willing to bear arms?

    49. If the law requires, are you willing to perform noncombatant services for the US armed forces

    50. If the law requires, are you willing to perform work of national importance under civilian direction– this one I have no problem with.

Your help would be appreciated. Thanks.

Employment is not necessary. At the risk of using terms from another decade... that would exclude housewives or home-builders or domestic-consultants or whatever is the politically correct term these days. It would also exclude people who are retired.

Those 3 questions are clauses that you must swear to as part of the oath. It is possible to request a modified oath that does not contain one or both of the first two of those clauses if you can show a religious or conscientious objection. See USCIS Policy Manual, Volume 12, Part J, Chapter 3, section A for more details. Note that the US does not currently have a draft, and has not had one since the Vietnam War. It is politically unlikely for there to be a draft in the future.

This is my personal opinion and is not to be construed as legal advice.

In addition... when it comes to the Oath.... you don't need to use religious terminology if you choose not to.
"Solemn Oath" replaces any reference to "Swearing" and the closing phrase "So help me God" can be omitted.

My brother did answer in negative to first question on religious grounds. He got his citizenship without any issue but that was about ten years ago.
