  • Travelling to India ,week after oath

    Hi,
    Need advise.
My India trip was booked before I received the interview date. Usually, at the center, in case of successful interview, oath is same day.
    This is my concern.
    I receive my citizenship.
I will work to get the US passport expedited (Have been told that can be done in a day).

Will I be able to travel to India on my Indian passport?(Even after getting the US passport)
3-month grace period for travelling on indian passport after getting foreign passport will not lead to any issues?
And my re-entry in US ,will that create a problem?

    Thanks

If you are willing to go to one of the "same-day" offices or pay for a courier company to do that for you.... you will have a US passport in time (barely).
Sorry I don't know anything about a 3 month grace period. Is that a USA rule or an Indian rule?
Once you are a US citizen the USA rules apply for all US entries and exits at the US border. As you know, You will no longer have your green card.

    Here's the info on same-day passports: https://travel.state.gov/content/tra.../get-fast.html
    and here : https://travel.state.gov/content/tra...-agencies.html

      Hi,
      Thanks for your answer.

1.I will get expedited US passport the day after my oath ceremony.
      2. My issue is that I may not get eVisa to India within the 5 business days I have before my travel to India
      3. Indian consulate website says " A grace period of 3 months is allowed from the date of acquisition of foreign citizenship, for the purpose of travel on an indian passport"
I am not sure, that Indian immigration officials at airport will be aware of this and might cause me trouble.

Looking to see if somebody has an experience of similar.

      Thanks

I understand the question better now.

I believe India recently allowed dual citizenship didn't they? The details are here..

        https://www.immigrationlawadvisor.co...itizenship.php

Hopefully someone from INDIA will step up and answer your SPECIFIC question because I would be guessing

I know for other countries you can cross the USA border using the US passport and then cross the "foreign" border using their passport. In other words travel with BOTH passports.

EDIT: From the sound of what you are saying... the 3 month grace period is there to help people in your exact situation. If the Indian Immigration folks don't know this it would be a surprise to me. It can't hurt to print out those regulations and take them with you (in both languages). Wouldn't an immigration supervisor be trained well enough to know if you ended up having any issues? (rhetorical question). You know Indian bureaucracy better than I do.

I got an evisa for India two weeks ago in less than 24 hours.

Traveling back to the USA on your Indian passport is messy. Getting an airline to board you without a visa or green card is unlikely.

          Plan on changing your plans.
