Correction.Hearing before U.S. District Court. 120 days lapsed!!

My N-400 application was never denied or approved. 120 days have lapse as of July 1st,2010. Can I still request for a hearing in front of a US district court? How? Should I have legal representation for this step up? Should I just reapply with a new N-400? Any legal referrals someone can recommend? Not much dough. Desperate!!

I am interested in knowing about your case. My case is 25 days away from 120 days. I still do not know why and I really would prefer not going to court. If I had to, I wish it was done earlier. And is going to court automatic after 120 days?

After posting my inquiry, I called USCIS and asked about the status of my application since 120 days have lapsed and also asked about procedures to file a request for a hearing in front of a District court. (my right as stipulated on the interview response form) Not automatic, you would have to file a form N-336 if you want a hearing. They told me that I needed to wait for another 45 days and gave me an inquiry file number. I received a response the next day(literary) informing me that IT HAD BEEN APPROVED!!!! It included the file number received the day before. So. hang in there, call, inquire and be patient. If it has not been DENIED, you are still playing Ball.

So happy it worked out for you, congratulations. Out of simple curiousity, did they give you any reason for the delay? Does it seem like they just 'dropped the ball' on your application?

I had my interview in mid March. Passed the test. They did not gave any decision and still waiting for one. I tried couple of times to call USIS but it always take you to some automated messege center.

it will be a Great help if you could share as how you were able to talk to a representative. please share.
