  • Public benefits while LPR

Hi all. I am LPR and my family (wife and kids) are US citizens. It looks like we might need to apply for non-cash benefits (mainly health insurance) for my wife and kids (not including me). Does anyone know whether it count against me when applying for citizenship or not?
I am confused about the rules around benefits. If I understand it correctly, I am, as LPR, not allowed to use any public benefits for 5(?) years, but I am not sure whether it applies to my US citizen family members.

    Thank you

Applying for citizenship, as in completing the actual form, does not require documentation of health insurance. I don't see how application for health insurance will affect your application. That being said, USCIS doesn't treat transactions within marriage separately between couples, what one does affects the other. The health benefit received should be placed on your joint-tax return and usually comes on a 1095C Tax document.

However, applying for health insurance is expected and can be used as additional proof of a legitimate marriage. My hubs is a US citizen, we have always had heath insurance through Blue Cross Blue Shield. We always included the Health insurance policy as supporting docs when filing for I765, I485, I130 etc. We are now at the stage of waiting for citizenship interview date and have never had an RFE (filed all documents without an attorney) or refusal of documents because we had/have health insurance.

If its the regular and expected health insurance you should not have a problem. However, if it is monetary transaction such as SNAP-food stamps, TANF-Temporary Assistance for Needy Family you might have an issue.

    All the best.

Thank you for you reply, Hotaru-Grace. I'm sorry, perhaps, I did not word my question correctly. What I wanted to know was if we applied for health insurance for our US citizen children (medicare -CHIP in Texas where we are), would it be considered as public charge?
