  • N-400 tax return question!!

    Hi

    I've been a green card holder for more than 5 years now. I want to apply for my US citizenship. All these 5 years I have been working part time and never had to file for my tax returns for having low income. I have all the W-2 forms. Does anyone know if that will affect the approval of my N-400 application? If not, Do I have to send USCIS copies of these W-2 forms or letter from IRS stating I didn't have to file??

    You should have filed as you probably had a refund due to you, you should see a tax preparer about that.

    If you were not required to file then you did not fail to file for N-400 purposes.

    Are you absolutely sure that you were NOT required to File? See a tax expert about that.

    Since you qualify based on 5 years instead of 3 years, tax evidence is less important, USCIS really doesn't need it. They would only be concerned if you were a tax cheat.
