  • N400 Interview Experience; Unusual experience

    Hi everyone, just wanted to share my unusual N400 interview experience in case anyone else has gone through something similar. My FO is in Montgomery, AL, and I submitted my N400 app in March of 2023. The biometrics and interview were scheduled in short order and everything seemed to be going well.
    I had my N400 interview on 7/11/2023, and was recommended for approval on the spot (The N-652 form said congratulations! You've been recommended for approval). I was then given the option to attend a same day oath ceremony, which I accepted. The officer escorted me to the waiting room, where I waited for 30 mins before being escorted to another room. I turned over my GC and took the oath in another room. At this point, the presiding officer informed all of us in the room that about half of us would not be receiving our Naturalization certificates because the "system was having issues." Our GCs were returned to us and we were told to GTFO. I tried to ask one of the officers what the next step was, but he told me "we will send you a letter." It's been 7 weeks since that appointment, and I've attempted to call USCIS and ask for a Tier 2 officer, but my request was denied. I reached out via emma twice and was told that USCIS has 120 days to make a decision. My status still says "Interview was scheduled" and I have yet to receive a letter.
    I understand if sometimes cases need some time for supervisor approval, but it's mind boggling to me how a case can go from potentially being naturalized on the spot to a 7 week delay with crickets on the other end. I mean even cases that receive a "decision cannot be made" at the end of the interview get the oath scheduled within a few hours to a few days. I'm almost certain my case has been forgotten about and is gathering dust somewhere in the bowels of that miserable building.
    For anyone wondering, my case is very straightforward. No criminal history, one parking violation to the tune of $130 in the last 5 years (ticket was paid), no outstanding taxes, no previous immigration violations, and no spouse or kids. My GC was obtained via work.
    In any case, vent over and I hope that someone going through something similar can find some solidarity by reading this post. Guess it's time to start putting money aside for a lawsuit.

    This happens quite a lot. You were may be just unlucky. You can't do anything unless you are on the other side of the 120 days wait. Once 120 days have been past, you can submit an Ombudsman request - https://www.dhs.gov/case-assistance

      Thank you very much. I'll do exactly that and report back. I'll probably reach out to my congressman too and see if he can stir the nest.

        Yes, I was going to actually advise you to reach out to your congressman. I recently had to seek help regarding my passport and I was helped right away!

          Do you think there's any benefit to reaching out to my congressman before the 120 days are up?

            Yes, absolutely. Just make sure, you provide all the details. USCIS is known for it's high handedness and inefficient processes and systems.

              "Hello Everyone,

              I wanted to share my recent experience with the N-400 (marriage-based) application process. I filed my application on March 3, 2023. My biometrics were retaken on April 10, 2023, and today I had my interview after a considerable wait. I passed the interview, but a final decision was not made. The immigration officer (I.O.) requested additional documents.

              During the interview, the I.O. asked me the civic test questions. I answered the first six questions correctly and also successfully completed the English test.

              The I.O. was professional and courteous throughout the process. After reviewing my application, I was asked to recite the Pledge of Allegiance. However, the I.O. requested further evidence, including three years of joint tax returns since 2018, a bank statement, and insurance information. Initially, everything seemed fine, but then the I.O. suddenly requested additional documents, specifically requesting that the bank statements show transactions.

              I'm curious to know if anyone else has been in a similar situation. It's a waiting game for all of us. Should I consider reaching out to my senator for assistance? Prior to the interview, I had submitted all required documents online, and extra documents were not requested. However, during the interview, the I.O. requested these additional materials. I promptly uploaded the requested documents within an hour as instructed, but I have yet to receive any further communication.

              I wish everyone the best in their immigration journey. It's a challenging process, and we all hope for a positive outcome."

                if congress request will not help, it means usually there is something USCIS is checking, thus it could take a lot of time. You case is straight forward, and my friend's was, he sued himself and got approval. ​

                    I do have to wait for 120 days though or just sue before 120 days?

                      Examination of your N-400, Application for Naturalization, shows that additional information,

                      documents or forms are needed before your application can be acted upon. Please see attached

                      and respond by December 10, 2023.

                      Failure to do so may result in the denial of your application.

                      Submission of this information, however, does not guarantee that this case will be approved. We

                      strongly recommend that you submit all the requested information, documents, or forms as listed on

                      the following pages at one time and as soon as possible so that we can resume processing. Any

                      interim benefits that may otherwise stem from the filing of this application or petition will be delayed

                      while this case is in suspense awaiting your response.

                      If you choose to submit only some or none of the requested information, then the application will be

                        you must wait 120 days! on day 121 you can sue! Also it's good to show that you tried to contact USCIS to resolve the issue within the 120 days period...
