  • Green Card Category affect n-400 application?

    Hello, I was approved for my green card a few years ago. They gave me category Fx6 “married to a permanent resident” and the card is valid for 10 years. My spouse actually got approved for her Naturalization and became a citizen a month before I got approved for my green card. I have a few question.

    -Would I need to update my category for my green card if I’m gonna apply for my n-400?

    -Can I apply for my n-400 on the 3 year mark since my wife is technically a US citizen and not a GC holder?

    -what does “exempt from country limitation” mean on catergory Fx6?

    The category is irrelevant to your eligibility for the 3-year rule. To be eligible for the 3-year rule: 1) you need to have been a permanent resident for at least 3 years (can file 90 days before reaching this), 2) you must have been married to the same person for at least 3 years at the time of filing, and 3) your spouse must have been a US citizen for at least 3 years at the time of filing. People whose spouses naturalized after they got their green cards can still be eligible for the 3-year rule.

    Your category is wrong since your spouse was a citizen at the time you got your green card, but it shouldn't make a difference for your naturalization.

    (But if you had any children who immigrated as your derivative beneficiary, that would be a problem, as you were really in the Immediate Relative category, which cannot have derivative beneficiaries.)
