  • Can I file 90 days earlier?

    I am going to file N-400 via marriage to a citizen. I have got my green card for more than 3 yrs already.
    Owing to my job, i got to go back and forth to other countries in the past years. The only concern i have is the physical presence of 18 months in the last 3 years. Right now i counted i have accumulated 14 months, can i file 90 days before i got 18 months in US?? i.e. 15 months.

    I think the filing requirment itself stated that if you are filing N- 400 on marriage basis then your presence in US should be 18 months minimum at the time of filing and For others its 30 months. As far as i think you should wait for 4 more months for making 18 months in US. USCIS is very much picky and stubborn about there rules.You can file your N-400 now but for sure they will either send your application back OR will delay the procedure untill you fulfill there all requirments.
    If I am on your place then i would wait for 4 more months instead of making my case more complicated in form of Long delay.
    Still Its my opinion and i am not an attorney so you can wait for more replies or take legal advise.
