  • USCIS mistake - we pay for it?

    My Mom has been leaving with us for 6 years and we applied for her for Citizenship on January 2011.
    We received letter for finger prints in the begging of March 2011. We went there and did it, but we got a second letter to go again because the previous one was not good. We did this also. She went for interview on May 25th 2011 and she passed the exam, but the offices ask he r to get e clearance letter from our police department because her finger prints are not good. We get the letter on May 27th, mail it on June 1st (certify mail) and Post office indicated that they delivered the letter on June 7th.
    We have been waiting …. I ask my lawyer to go to USCIS and check up for status. She went there on July 21st, talked with the officers and they told her that they have everything and that we will received a letter very soon. Yes, we got the letter on July 25th but with DENIL decision - they indicate that they did not received the “Clearance letter”. My lawyer talked with them again and they acknowledge their mistake but we have to file a form N-336 for hearing and pay a fee of $650 … Why?
    What is going to be fallow?
    Do we have any rights?

    A very similar thing happened to us as well - not with the Naturalization but for green card renewal. We sought the help of our congressman and got it resolved. It took about 6 months to resolve the issue, but none the less it got resolved. Good luck with your case.

      I am sharing that from a friend experience: USCIS did the same thing about her $1070 for Green Card, but she had her receipt showing USCIS got the money. She went to her district representative ( congress) and explained the problem. The representative called right away the USCIS, and everything went well. Never paid another a fee and the Green Card showed up in a week! Try this; I would do. It is free and it is your right! Good luck.
