N400 for aged parents who never filed taxes or owed IRS

  • N400 for aged parents who never filed taxes or owed IRS

    Hi I am planning to file for my parents US Citizenship forms N400. My parents are Indian citizens aged 66 yrs and 71 yrs respectively. They came to US on green card in Jan 2003 and till now had never filed US tax returns or my home country based tax returns. They are both unemployed aged and live retired life. They stay with my sister in US (CA) who takes care of them. They do not get any social security benefits or any cash assistance as well. My sister has not claimed them on her tax returns as dependants.. How should i go about filing US citizenship for them..? Do i need to submit a letter explaining these circumstances along with N400 or only at the interview stage if asked to provide. Will they deny citizenship because they failed to file return even though they didnt have any income.

    Please advise.

    They should be fine. Just file the n-400 and on the question about taxes, answer that they dont owe IRS taxes. You are not required to file a tax return if you have no income.

      Thanks for your reply. At the moment my parents are geting free Medical under California government. After becoming US citizen will that be cancelled ? I have heard that people get moved to fed medicare programme. But my parents have never worked so would they be eligible to get medicare after becoming citizens ?

      Also what document shud i send with n400. 2 photos + cheque for biometrics and processing fees.

        You also need to send photocopies of their greencards, front and back!

          Draft letter for not filing US tax returns

          Hi All This is the draft letter that i have prepared for my mom and dad's reason for not filing US taxes. I am assuming the letter need not be sent with N400 unless they ask for it. Can some one please review and advise if what i wrote is okay..Any tips will help

          I am a lawful permanent resident of the United States of America since Jan 2003. I am applying for my US Citizenship by filing the N400 and as required I have paid up the requisite fees for naturalization.

          With the N400, I am unable to submit the tax returns, reason being that I am unemployed and have no income. I do not owe taxes to any federal, state or local tax authorities. In view of this, I am not required to file and have not filed any tax returns with IRS or the franchise tax board of the State of California.

          I declare under penalty of perjury under the laws of the state of California and the laws of the United States of America that the foregoing is true and correct.

            I don't think that you need to submit this letter with the N400 application. You can send this in when they ask for it later and you can have it with you during the interview just in case the issue comes up.
