  • Potential Misdemeanor Conviction & N400

    I need some help guys.

    I am 25 and approaching the earliest possible date where I could apply for naturalization (N400) -- which would be January 27 2012.

    A little problem:

    I just found out that I am being charged with Misdemeanor Assault PC245 in California by the D.A. I have already hired a lawyer and have not bee "convicted" yet -- I also do not have any criminal history.


    Few questions:

    1.) By January -- if the case is NOT closed, should I still apply and be honest on the application that there is a "active case" ?

    2.) Worst case scenario, if I do get convicted of said Misdemeanor charges -- would that completely stop me from ever getting citizenship/naturalized?

    I'd certainly appreciate it if someone could help.

      I would suggest that you consult an immigration attorney about this issue.

      One note since you stated that you are 25: Did you register with Selective Services? You will be asked for that during naturalization since if you have been an LPR between the age of 18 and 26, you need to register.

        Yes I have already registered with the selective services. Are immigration attorneys expensive?

          The best thing is to wait to be done with the charge than apply now. They will do the backround check and if they find out that something is not right, they will ask to bring prove. it can delay your application; and if you do not tell them the truth and they find out that you lie, they will deny your application.
