  • Citizen eligibility - continuous residence vs Study Abroad

    I am a permanent resident since Jun 08
    I took a trip back to my home country in order to finish my last year college and it lasted for 10 months (ie. that is Aug 08 - Jun 09)

    My question is : Whether that period of time able to consider I still maintained continuous residence in U.S. and I am able to apply for naturalization in 2013?

    According to USCIS website :
    "Absences of more than six months but less than one year may disrupt an applicant’s continuous residence unless the applicant can prove otherwise,

    .......(A) The applicant did not terminate his or her employment in the United States;


    (B) The applicant's immediate family remained in the United States;


    (C) The applicant retained full access to his or her United States abode; or


    (D) The applicant did not obtain employment while abroad
    "


    In my case,
    A) I didn't employ before my leave since I was a full time student.
    B) My immediate family, which is my parents, remained in U.S at that period of time.
    C) I retained full access to my U.S. home. I got U.S. Bank Account and I got statement from my U.S. Address at that period of time.
    D) Since I am a full time student, I didn't obtain employment while abroad
    (I didn't file tax return in 08, since I didn't have income but I am a dependent in my parent tax return, does that relevance? anything else I can prove I did not disrupt the continuity since the regulations state that " but are not limited to" the above )

    And the case LI v. CHERTOFF 490 F.Supp.2d 130 (2007), it seems like it can support my argument that I didn't abandoned my U.S. residence for that period of time, is that ture?

    I have posted this question couple months before. A nice member here advise me to talk with infopass. I tried to go that way but they seems can't provide me with any solid answer. That's why I have to re-post it again to see anyone could share their opinion and experience.

    You did not stay out of the US for more than a year and you went to finish your studies. Looking at your post, it looks like you are in good shape. If you decide to apply, take as many documents as possible with you to the interview to prove what you posted above. So you will be prepared if the interviewing officer asks for them.

      One more question, filing fee for N-400 is $680. I know that is non-refundable. But if my case unfortunately get denied, do I need to pay for the fee again for another application?
      (I think the answer should be YES. The govt want to squeeze more money as much as they possibly can )

        Yes, the answer is yes. You would need to pay again. However, in your case, if you have all the documents backing your case with you at the interview you should be doing fine.

          Same situation as marqzho or more complicated

          Hello marqzho,

          My son & daughter are in the same situation as marqzho. Our case more complicated. They went out of USA 3 times in last 3 years. Each year they come one month for vacation to live with parents. They are full time students in india. They will have to continue this for another 3 more years. Now they stayed almost 920 in usa for the last 3 years. They are eligible to apply but with the following conditions: They are on my taxretuns, they have us driver license, they are on my dental & vision insurance, parents live in USA, we live in an apartment.

          These attorneys say...they can present the case and argue. But, no one is realistic and are not talking for real. Who is the best citizenship lawyer if you guys know who can handle complex cases like this.

          Hi marqzho and Others: Do you think they are good to apply? Because if they miss now...they can not apply until another seven years from now. Please share your experience with me because....your case is better than my children case. I can leave my personal email address...if it is ok for you.

          Here is the sample info my children travel in & out of usa:

            Per the USCIS, If you are absent from the US for a lengthier period of time, it may disrupt the continuous residence requirement. If you are abroad for more than six months but lesser than a year, it may disrupt your continuous residence unless you can prove otherwise. If you are away from the US for a year or more, it means that you have disrupted your continuous residence even if you have a re-entry Permit. If you are abroad for a year or longer, you can come back as a permanent resident if you have a Re-entry Permit. But the time you were in the US before you left the country will not count toward your time in continuous residence.

            If you come back within two years, some of the time you spent out of the country will count. In fact, the last 364 days of your time out of the country (one year minus one day) counts towards fulfilling the continuous residence requirement.

              Hi askask,

              I know this post is from a very long time ago but I am kind of like in the same situation here and I just wanted to know what was the conclusion in your children's case.

              Were they granted citizenship ?
