  • Need suggestion for Naturalization process

My daughter is going to India for educational purpose. She got her
Green card on August 5, 2008.

She is planning to go to India on July 27th, 2012, which means she will
complete almost 4 years of residency in USA with GC status.

I have some questions related her status, is she eligible to apply her
citizenship next year? If she is eligible, do we need to apply travel
document (re entry permit) for her travel or ask her to come USA before 5 months 29 days and go to India again.

If she apply for travel document (re-entry permit), does she loose her
4 years of residency in USA?

Your daughter needs to meet the continuous residence (no single trip more than 6 months) and physical presence (at least 30 months out of 5 years present in the US) requirements at the time of her N400 application.

I assume you as her parents will stay in the US and with that, this is proof that your daughter's stay abroad is only temporary for educational purposes and that she will have ties to the US. She is not giving up her US residency address which is with you and if she enters the US always without exceeding 6 months she should be fine. In that case, in my opinion, she would not need a re-entry permit, but to be 100% sure about your situation, you should consult with an immigration lawyer.

I am not an immigration lawyer and the above comments are just my opinion on this case.
