    I am on J1. My wife was on J2 initially, then she went on J1, finished her residency and went back to India hoping that she would be able to come back to US on J2. But the DS2019 was denied citing the reason that your wife was on J2 before, then she changed to J1, so now you cannot apply for J2 again. My wife wanted to take time off from further studies/work, hence we thought J2 would be an option. Any suggestions as to how she can come back to US would be helpful. Thanks.

    cant she get a waiver job and apply for waiver? you said she finished residency correct?

      Hi,

      I was in J1 from September, 2009 up to August 2012. Then I changed to J2 to my husband who was still in J1. Now when he was applying for waiver, I did not applied for a separate waiver as the website says J2 dependent does not need to do so if the J1 is already applying. He got his waiver. Now when he is applying for H1b and put my name as H4, his employer asking for my waiver saying that I also need the waiver as I was J1 once.

      Now, my questions are

      1. Since I am already in J2 and applying for H4, do I still need the waiver?
      2. Since I am already staying in the US for more than 5 years, can I apply for the waiver now?
      3. If I have to go back to my home country India anyway, can I apply for the waiver from there?
      4. Can I re-enter US without staying 2 years in my home country?
      5. If I am not getting the H4, and if my husband will get H1b, then when I have to leave the country without being illegal immigrant?

      Please answer my questions as quick as possible, if anybody knows as we are in very much urgency.
